Amputation of Oil Field Worker
A twenty-three (23) year old driver of oil field equipment was severely injured when rig parts he transported fell on his right foot. The impact of the fallen parts on his foot was so substantial that his entire right leg, up to his knee, had to be amputated. He now needs a prosthetic leg for the rest of his life and he has lost his ability to be a commercial truck driver. Foster & Svambera, PLLC , on the oil field worker's behalf, prosecuted his case against a drilling company that resulted in a settlement that was reached on the eve of trial.
Amputation of an Electrician
A thirty-five (35) year old electrician at an automotive parts plant was severely injured when he was performing maintenance on a German made air lay machine. His injuries were so severe that three (3) of his fingers had to be amputated. His livelihood as an electrician was taken from him and his employer terminated his employment. Foster & Svambera, PLLC filed suit on behalf of the electrician alleging that the German manufacturer was negligent in causing the electrician's injuries. After extensive discovery, including deposing the German manufacturer's president, the case settled.
Mesothelioma of a Pipefitter/Welder
An eighty (80) year old pipefitter/welder was diagnosed with mesothelioma after being exposed to asbestos-containing products while working for contractors at refineries, chemical plants, power plants, a paper mill, and a steel mill. He contacted Foster & Svambera, PLLC for representation and our firm quickly filed his case. He soon passed away and we now represent his family in the wrongful death case relating to his mesothelioma. Mesothelioma of a Cement Plant Worker
A forty (40) year old cement worker was diagnosed and later died from mesothelioma. Asbestos Related Lung Cancer (Non Smoker) of a Refinery Worker
After over twenty years of asbestos exposure, a sixty-eight (68) year old refinery worker was diagnosed with asbestos-related lung cancer. He had never smoked a day in his life. While working in an oil refinery, he performed various asbestos abatement projects, which brought him into contact with asbestos-containing insulation that was present on pumps, boilers, vessels, and pipes. Foster & Svambera, PLLC filed suit on his behalf against numerous companies that resulted in numerous settlements.
Asbestos Related Lung Cancer (Smoker) of a Municipal Worker
A sixty one (61) year old municipal worker for the Nueces County Water District was diagnosed with asbestos related lung cancer. During his career working for the water district, he worked with and around the cutting and fitting of underground asbestos containing water pipe. Foster & Svambera, PLLC filed suit on his behalf and prosecuted his case. After extensive discovery and pre-trial hearings, his case settled on the eve of trial.
Asbestosis of a Maintenance Worker
A fifty-two (52) year old maintenance worker who worked at a hospital for over twenty- five (25) years was diagnosed with asbestosis and asbestos-related pleural disease. Part of the maintenance worker's job duties required him to work with and around asbestos-containing products that were on boilers and pipes at the hospital. The maintenance worker contacted Foster & Svambera, PLLC to help recover compensation for his injuries. After filing suit, conducting extensive discovery, which included the taking of numerous depositions, his case settled at mediation.
Asbestosis of a Pipefitter/Laborer
A fifty-five (55) year old pipefitter/laborer was diagnosed with asbestosis many years after being exposed to asbestos at a shipyard, paper mill, steel mill, power plant, as well as while working at chemical plants and refineries. He retained Foster & Svambera, PLLC to help him recover compensation for his asbestos related injuries. Over time, his condition became worse, and eventually he had to have one of his lungs surgically removed. During this time, our firm assisted him by obtaining compensation for him through settlements. Unfortunately, he recently passed away and we now represent his family in an effort to recover compensation on his remaining claims.
Fatality due to Burns from Plant Explosion/Fire
A fifty-eight (58) year old worker was tragically burned after a plant explosion/fire erupted at a facility in Graham, Texas. The worker spent extensive time, with burns covering nearly 70% of her body, in the burn unit before she passed away. OSHA cited her employer with numerous workplace violations. Foster & Svambera, PLLC filed suit on behalf of her survivors (her son and her daughter) alleging that her now former employer and a coverall designer/manufacturer are liable to her survivors. The case is currently being litigated.
Fatality due to 18 wheeler/Trucking Crash
In the aftermath of a hurricane, one of our client's sons lost his life in an 18 wheeler crash. The crash took the life of one, and left another paralyzed. Foster & Svambera, PLLC helped represent the mother in the wrongful death case involving her deceased son against the trucking company. Extensive discovery followed and ultimately, the case settled.
