Amputation Victims Require Experienced Legal Help
At Ryan Foster & Associates, PLLC, helping amputees and their families move forward after the injury is a central part of our law firm's mission. Please contact us if you or a family member has suffered disfigurement or limb loss in a motor vehicle or work accident.
If you are coping with amputation, as a victim or someone who cares, we encourage you to visit amputeeadvocate.com. Our law firm maintains this Web site to cover topics of interest to all those impacted by amputation.
We represent amputees who have lost entire or partial limbs, including hands, arms, legs, feet and fingers. We will put our experience and legal knowledge to work for you following catastrophic situations such as:
- A traumatic workplace injury related to the use of heavy machinery or farm equipment
- An industrial accident like a plant explosion
- Amputation injuries occurring on construction sites or other workplace environments with unsafe conditions
- Serious automobile accidents, including those involving commercial trucks and other large vehicles
Possible Financial Recovery Beyond Workers' Compensation
If your amputation occurred in a work-related accident, you may have been told that workers' compensation insurance provides your only opportunity to seek financial help. Fortunately for some victims — since this system places a "cap" on what you can recover for a disfiguring injury and does not provide compensation for pain and suffering — this is not always true.
Our attorneys evaluate all potential third-party claims in either a workplace injury or vehicle crash resulting in amputation. Too often, victims and less experienced lawyers may not consider the role of defective product manufacturers, contractors, consultants or others who may have been negligent. Recognizing the tremendous costs and emotional impact of amputation, we will thoroughly analyze all actions and parties involved in your case.
In September, 2008, the Amputee Coalition of America (ACA), announced that prosthetic parity legislation was introduced in the US Senate requiring health insurance companies to provide meaningful coverage for prosthetic care. The legislation is designed to ensure that amputees covered by private and group health insurance are able to access the prosthetic care they need to lead full and independent lives.
Prosthetic parity is now being considered in both chambers of the US Congress. The House version (HR 5615) was introduced on March 13, 2008. In order to build support, the ACA has organized several successful initiatives including a national week of action (98 events in 35 states over one week) in May and a lobby day this summer. Since then, they have continued to reach out to members and staff while working with activists to cultivate support from their lawmakers by holding meetings in the states.
